Should Judge Allow Gay Marriage Immediately in California?
Aug. 12, 2010— -- U.S. District Judge Vaughn Walker will announce today whether gay marriages are allowed to resume immediately in California or whether the state's ban on gay marriage should remain in effect until an appeals court issues its decision.
Walker ruled last week that California's Proposition 8 is unconstitutional.
"Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license," Walker wrote in his 136-page decision.
The judge signaled that gay marriage should resume immediately but agreed to put a hold on weddings until he could consider the legal arguments.
California Gov. Arnold Schwarzenegger and Attorney General Jerry Brown bsay gay marriages should be allowed to begin immediately, and they filed legal motions supporting that position.
Opponents say that resuming gay marriage could cause legal problems if the Court of Appeals or the Supreme Court overturns Walker's ruling.
