Tate brothers denied release amid UK extradition proceedings
A Miami federal judge on Wednesday denied Andrew and Tristan Tate's request for release from detention while the brothers contest their extradition to the United Kingdom on rape and sex-trafficking charges.
In her order denying their release on bond, U.S. Magistrate Judge Lauren F. Louis stated in part that the brothers "failed to meet their burden to demonstrate that they do not present a risk of flight or danger to the community, or that special circumstances warrant their release."
The brothers have been held in a federal detention center since mid-July, following their arrest in Miami on the U.K. charges.
U.S. federal prosecutors have argued that the Tates pose a flight risk because of their wealth and should remain in custody while the extradition case proceeds.
The brothers' lawyers have argued that the two have exaggerated their wealth as part of their public personas and should be released on bond.
Andrew and Tristan Tate both took the stand during their bail hearing last month, during which they denied the charges against them and argued that they need to be free to clear their names.
U.K. prosecutors have brought nearly 60 charges against the brothers, including alleged rape, assault, human trafficking and making pornography of a minor.
On Friday, Romanian prosecutors announced a new indictment charging Andrew Tate with trafficking minors, sex with a minor and money laundering. Tristan Tate was also indicted on charges alleging complicity in the case, Romania's anti-organized crime agency said.
The Tates have denied all allegations and have claimed they are being persecuted for their views.
In her order, Louis further stated that the brothers have failed to demonstrate that, as they had argued, their "continued detention renders it impossible to participate in the Romanian proceedings absent their release."
She also found that while the Tates "may not in fact possess what extravagant holdings they portray themselves as possessing online, the record reflects that they possess an exceptional capacity to flee the jurisdiction," citing in part their extensive international travel and ties abroad.
Joseph McBride, the Tates' attorney, said they "profoundly disagree" with the judge's decision to keep the brothers in federal custody.
"Andrew and Tristan deny the allegations and are prepared to confront them with evidence in open court," McBride said in part in a lengthy statement on X. "Release would acquit them of nothing. It would simply allow them to prepare their defense."
