Rhode Island prosecutor arrested for trespassing tells officer, 'You're gonna regret this,' body camera video shows

The Rhode Island Attorney General's Office said it is conducting a review following the arrest of one of its prosecutors, who could be seen on body camera footage telling an officer, "You're gonna regret this," while being detained.

Special Assistant Attorney General Devon Flanagan, 34, was arrested in Newport on Thursday for trespassing, according to the attorney general's office. Police responded to a call from a restaurant late that night "to investigate the report of an unwanted party," according to the arrest report.

In body camera footage newly released by the Newport Police Department, Flanagan repeatedly asked the officer to turn off his body camera and reiterated during her detainment, "I'm an AG."

"I want you to turn your body cam off," she tells an officer as he arrives at the scene on the sidewalk in front of the restaurant, the footage shows. "Protocol is that you turn it off, if a citizen requests it to turn it off."

Her friend then informs the officer that Flanagan is a lawyer.

"We're gonna leave, we're going to make it easy," Flanagan says after the officer tells them the restaurant wants them to leave, while continuing to bring up the department's "protocol."

The officer goes on to speak to someone from the restaurant who, when asked if "they want them trespassed," responds, "Anything we can do. Trespass, yeah … Cuff 'em, please."

It is not clear why Flanagan and her friend were asked to leave the restaurant.

After the officer tells Flanagan and her friend they were trespassing, the prosecutor says, "We're not trespassing, you haven't notified us that we're trespassing."

"What did I just say to you -- you're trespassing," the officer responds.

The officer says he doesn't want to arrest them. While repeatedly telling them to go, he says, "I don't want to deal with this."

Flanagan continues to request that the officer turn off his body camera, citing a "citizen protocol."

"Your protocol is, is if I ask you to turn off the body cam, you have to turn it off, and that's your protocol," she says in the footage.

Her friend tells the officer that Flanagan is a "f------ lawyer, so she knows."

"That's b------- lawyer stuff, so that's not true," the officer responds while continuing to tell them to leave.

When Flanagan proceeds to tell the officer, "I'm an AG," he responds, "Good for you, I don't give a s---. Let's go. We're going."

When the officer starts to handcuff her, Flanagan says, "I'm an AG," and asks what probable cause the officer has to detain her.

"You're being detained because you're not leaving," he says.

The prosecutor continues to state, "I'm an AG," as she's being led to the patrol vehicle.

"You're arresting an AG. Let me tell you something," she says. "You're putting me in handcuffs and you're not mirandizing me."

After she's placed in the patrol vehicle, Flanagan says, "Buddy, you're gonna regret this. You're gonna regret it."

Flanagan and her friend were arrested for willful trespass, a misdemeanor, according to the arrest report. Her friend was additionally arrested for disorderly conduct and resisting arrest, both misdemeanors, according to the arrest report.

ABC News has reached out to Flanagan for comment but has not yet received a response.

She is assigned to the criminal division's appellate unit, according to Rhode Island Attorney General Peter Neronha's office. She has been with the office for approximately seven years.

The attorney general's office said it "immediately began a review of the incident" upon learning of Flanagan's arrest.

"At this time, we are unable to comment further on this matter as it relates to personnel issues," the office said.

According to the Newport Police Department's body camera policy, situations where an officer may stop recording include requests from victims or witnesses.

The policy notes that "consent to record is not required."
